To make a very long story short, basically what that is all about is them being upset and arguing about the Courts telling them NO once again in their apparently unending efforts (and also apparently unending list of motions and arguments filed in the dismissed lawsuit) all to get hold of and see Danny Shelton's private and personal bank records.

You forget that Hillman essentially said YES, that we could see the bank's records, on September 11, 2008.

You further fail to quote where we have requested the court to possess or see those records in the motions filed since last fall.

3ABN filed their objection to Pickle and Joy's latest motion on April 15, 2010, just as they said they would, and here is that memorandum:

What's this about a cigar? Huh? In the District of Massachusetts, we are REQUIRED to file proposed documents along with motions for leave to file.

BEST LAWYER/INSURANCE STORY OF THE YEAR,
        DECADE, AND POSSIBLY THE CENTURY.

This took place in Charlotte North Carolina. A lawyer purchased a box of very rare and expensive cigars, then insured them against, among other things, fire.

Within a month, having smoked his entire stockpile of these great cigars, the lawyer filed a claim against the insurance company.

In his claim, the lawyer stated the cigars were lost 'in a series of small fires..' The insurance company refused to pay, citing the obvious reason, that the man had consumed the cigars in the normal fashion.

        The lawyer sued and WON!
Delivering the ruling, the judge agreed with the insurance company that the claim was frivolous. The judge stated nevertheless, that the lawyer held a policy from the company, in which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be unacceptable 'fire' and was obligated to pay the claim.

Rather than endure lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000 to the lawyer for his loss of the cigars that perished in the 'fires'.

        NOW  FOR THE BEST PART...

After the lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON!!!

With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000 fine. This true story won First Place in last year's Criminal Lawyers Award contest.

ONLY IN   AMERICA .... NO WONDER THE REST OF THE WORLD THINKS THEY'RE NUTS.

I am correct. A simple fifteen minute review of Westlaw evidences that there has been No case with this scenario anywhere in the Federal or State court systems in this country. If there had been, the published or unpublished decision would be available via Westlaw.

laugh, I wonder if they have our state or federal scenario correct? Better yet --wonder if they have it at all. not all stories are told and total ignorance to believe they are. Snoop consisted of a couple out in California (I believe) just doing their thing and most of it is made up or to the best of what they heard and some follow it hook line and sinker.

I'll give it one more try and if that doesn't work will leave you to your own devices.

Quote from: Westlaw
Westlaw is one of the primary online legal research services for lawyers and legal professionals in the United States and is a part of West, a part of Thomson Reuters. In addition, it provides proprietary database services. Information resources on Westlaw include more than 40,000 databases of case law, state and federal statutes, administrative codes, newspaper and magazine articles, public records, law journals, law reviews, treatises, legal forms and other information resources.

Most legal documents on Westlaw are indexed to the West Key Number System, which is West's master classification system of U.S. law. Westlaw supports natural language and Boolean searches. Other significant Westlaw features include KeyCite, a citation checking service, which allows customers to determine whether cases or statutes are still good law; and a customizable tabbed interface that lets customers bring their most-used resources to the top. Other tabs organize Westlaw content around the specific work needs of litigators, in-house corporate practitioners and lawyers who specialize in any of over 150 legal topics.

Westlaw was originated by West Publishing, a company whose headquarters have been in Eagan, Minnesota since 1992; West was acquired by Thomson Corporation in 1996. Several of Thomson's law-related businesses outside the United States have their own Westlaw sites, and Westlaw's international content is available at www.westlawinternational.com. For instance, Westlaw Canada from Carswell includes the Canadian Abridgment and KeyCite Canada,[1] and Westlaw UK provides information from Sweet & Maxwell and independent law reports, case analysis and case status icons.[2] More recently, Westlaw China was introduced, with laws and regulations, cases, digests, and status icons (similar to KeyCite flags), for the law of the People's Republic of China.[3] In total, Westlaw is used in over 68 countries.

One more time: A simple fifteen minutes of research on Westlaw revealed that there has never been such a case in any State court system, nor any Federal court. It never happened. Your welcome to try and find the opinion which would have been generated by such a case and if you do, please post it. I won't hold my breath.

tinka,

You know how sometimes you just have to nod and wink and just let somebody be right because you know if you don't they'll blow a gasket??  This might be one of those times!!   ;)    After all, the legal ego can be so fragile...be it attorney, paralegal, whatever...
