Why, Bob?

I called the clerk's office in the Massachusetts 1st circuit court of appeals this morning because the deadline for Pickle and Joy filing their brief in their appeal case regarding the dismissal of the lawsuit against them has come and gone, and there has been nothing new added on PACER. They already asked for and were granted an extension for filing.

I was told that neither Pickle or Joy have bothered to file anything, even though the deadline for doing so was 02/18/09

I posted about this on the other forum, but I am not allowed to give a link to that here as it is against the rules of this forum. ( my apologies)

On the off chance that the name of the thread from the other forum will be allowed here without censorship, it is
"Lawsuit update -- No appeal brief filed by Pickle or Joy"

More will be being posted. Discussion there, as well as explanations and answers are welcomed.

Read the rules, and you'll understand. It makes total sense.

I highly doubt you were told that neither of us "have bothered to file anything."

Ian, why don't you let us all know when you find the appellant brief on PACER, OK?


And by the way, no need to apologize for the rules here.  I'd say it would be the rules (or lack thereof) on your own smut site you probably should be concerned with!!

I'm sorry, sigh..  I did read the rules, but I don't understand. I really tried to figure out what you were referring to, but I just don't get what rule you are talking about. I guess I need you to help me by explaining what rule and how this makes total sense. Can you, please?

And Bob, if there is some mistake, then I am sure we can both agree that it needs to be straightened out asap. Here is the contact information for the appeals court just in case you or another wants to call as I did and ask questions, or do that. They were very polite, helpful, and informative when I called.

No need for me to call the 1st Cir. clerk. They know the rules. Even though I'm pro se, I wouldn't want to look stupid.

Let's see. When does one have to file one's tax return? What do you have to do on that date in order to file?

Umm, So, Bob...  is that what all the cryptic comments are about? you dropped the brief in the mail on the due date, and are claiming that like your income tax return the postmark makes it on time?

You keep referring me to the rules, but where is that rule exactly?

And even if so, knowing the court doesn't have it yet, why would you post "Appellant brief filed", and claim "It was a lot of work, but we got it done and filed on Wednesday." instead of just honestly and plainly saying that it was mailed on Wednesday?

There was a non-answer if I've ever heard one.

All I did was ask a simple question. I wasn't trying to interrogate you. I'm just trying to understand why someone who says they have no connection with 3ABN or the Sheltons is so interested in every minute detail of this lawsuit and every allegation that is brought forth.

Duane, I found your inquiry to be spot-on.  And the non-answer was just that.  You and I and several here have unfortunate, first-hand experience with 3ABN and/or Danny Shelton.  I gave weeks of my time and professional expertise in addition to a substantial donation, all of which I now fiercely regret.  I am NOT convinced that my money didn't go to line Danny Shelton's pockets rather than to help spread the story of Jesus as I originally believed to be the case.  I intend to fight this battle to the end as I don't enjoy being conned into donating my hard-earned money to a deceiver.  If that is obsession, then so be it.

Cindy, what's your excuse?  I have a suspicion that you are motivated in part by one ex-attorney who has a bone to pick with Gailon.

My! So if you file your tax return on April 15 by sticking it in the mail, are you a liar if you say you filed it? Do you have to ask permission to file untimely if you mailed it by April 15?

It is hard for me to fathom that you would ask the questions you did. And that you would suggest at your smut site that we didn't file a brief simply because the courthouse didn't get it yet.

I already told you to read the rules, more than once. Which you obviously haven't done.

It's Fed.R.App.P. 25(a)(2)(B).

We timely filed the brief by mailing it on Wednesday. All 100 pounds and 9800+ pages worth.

 Seriously I look forward to reading it. Of course it would be easier if you just posted it, and shared it with me and everyone else as you did with Snoopy..  But as you don't appear to want to do that, I'll have to order it from the court and share it with everyone who is interested myself. I'm  certainly glad I don't have to pay for every copy and page you sent...

I think your saying the IRS example was non responsive and unrelated is downright rude. It was neither non responsive nor unrelated.

And talking about dancing around for days, could you please get your facts straight? This discussion started on Friday, and I cited the specific rule, since you apparently were having trouble finding it, on Saturday night. How is that days?

The bottom line is that you spread the false rumor that we had missed our deadline, because you either didn't read the rules or didn't understand what you read. And I personally do not appreciate your spreading falsehoods about our case.
